(C)和(CC)可以共存

Copyright及其(C)标志和Creative Commons及其(CC)标志可以一同使用吗?有关这个问题,我不久前分别咨询了CC美国和中国的专家,答复如下:

All CC licenses are based upon copyright -- the rights you grant in a CC license are yours because of your copyright. So saying: Copyright (C) 2009. This work is licensed under a Creative Commons Attribution-Noncommercial-Share Alike 3.0 United States License. Indicates that you own the copyright and that your are giving up some of those rights under the CC BY-NC-SA 3.0 US license.

CC中国大陆项目组的法学专家认为你提到的那种写法: Copyright (C) 2009. This work is licensed under a Creative Commons Attribution-Noncommercial-Share Alike 2.5 China Mainland License. 在法律上是没有问题的,但容易造成误解,建议将(C)换成CC的双C图标。但All rights reserved的字样肯定是不能用的,因为与后面的说明矛盾,可以用Some rights reserved。

看来我之前是多虑了。不过像百度百科那样标榜CC却纵容侵权,在网页中使用“(C) 2009 Baidu”造成百度私有版权的误读,确实是有问题的。

顺便说一下,使用CC搜索或在google时加上Usage rights选项,是提高搜索结果质量和可信度的途径之一。当然,它在提高查准率的同时会降低查全率。但这在抄袭成风、以讹传讹的中文网络世界中还是很有意义的。
